Welcome to Resonance. Please read these Terms of Service ("Terms") carefully before using the Resonance mobile application (the "App") operated by Resonance App ("we", "our", or "us").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Use of the App

1.1 License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

1.2 Restrictions

You agree not to:

  • Copy, modify, or distribute the App or its content
  • Reverse engineer, decompile, or disassemble the App
  • Use the App for any unlawful purpose
  • Attempt to bypass any security features of the App
  • Use automated systems to access the App
  • Resell or commercially exploit the App without our permission

1.3 Account

The App does not require you to create an account or provide personal information to use its core features. All your data is stored locally on your device.

2. Health Disclaimer

IMPORTANT: The App is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

  • The breathing techniques provided are for general wellness and relaxation purposes only
  • The App is not a substitute for professional medical advice, diagnosis, or treatment
  • Always consult your physician or qualified healthcare provider before starting any new breathing practice, especially if you have cardiovascular conditions, respiratory issues, anxiety disorders, or are pregnant
  • If you experience dizziness, discomfort, or any adverse effects while using the App, stop immediately and consult a healthcare professional
  • Do not use the App while driving, operating machinery, or in situations requiring your full attention

You use the App and practice breathing techniques entirely at your own risk.

3. Subscriptions and Payments

3.1 Free and Premium Features

The App offers both free features and premium features available through subscription. Free features remain accessible without payment.

3.2 Subscription Terms

If you purchase a subscription:

  • Payment is charged to your Apple ID or Google Play account at confirmation of purchase
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel subscriptions in your device's account settings

3.3 Refunds

All purchases are processed by Apple (App Store) or Google (Play Store). Refund requests must be made directly to Apple or Google according to their respective refund policies. We do not have the ability to process refunds directly.

3.4 Price Changes

We reserve the right to change subscription prices. Any price changes will take effect for the next subscription period after notice is provided.

4. Intellectual Property

4.1 Our Content

The App, including its design, code, graphics, animations, sounds, and content, is owned by Resonance App and protected by copyright, trademark, and other intellectual property laws. You may not use our intellectual property without our prior written consent.

4.2 Your Content

You retain ownership of any custom breathing techniques you create within the App. This content is stored locally on your device and is not transmitted to us.

5. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to our data practices as described in the Privacy Policy.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

  • The App will meet your specific requirements
  • The App will be uninterrupted, timely, secure, or error-free
  • The results obtained from using the App will be accurate or reliable
  • Any errors in the App will be corrected

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RESONANCE APP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use of or inability to use the App
  • Any health effects or outcomes from using breathing techniques
  • Any unauthorized access to or use of your data
  • Any errors, bugs, or inaccuracies in the App
  • Any third-party content or services accessed through the App

In no event shall our total liability exceed the amount you paid us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

8. Indemnification

You agree to indemnify, defend, and hold harmless Resonance App and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.

9. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

You may terminate your use of the App at any time by uninstalling it from your device.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the updated Terms in the App or on our website. Your continued use of the App after changes constitutes acceptance of the modified Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located in the United States.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Resonance App regarding your use of the App and supersede any prior agreements.
